The European Parliament has decided to lift the parliamentary immunity of Polish MEP Mariusz Kamiński. This decision follows a request from Polish judicial authorities regarding alleged violations of the Polish penal code. The procedure takes place in a context where parliamentary immunity must be balanced with the principle of the rule of law.
The request for lifting immunity comes from the Polish Prosecutor General and concerns alleged violations of Article 244 of the Polish penal code. The objective is to enable Polish judicial authorities to continue criminal proceedings against Mr Kamiński for non-compliance with a final conviction issued in December 2023.
The decision takes effect immediately upon adoption. The President of the European Parliament is tasked with notifying the lifting of immunity to Polish judicial authorities and Mr Kamiński. The criminal procedure can thus continue in accordance with Polish law.
This decision demonstrates that parliamentary immunity is not a personal privilege but an institutional guarantee. It allows judicial authorities to exercise their competencies while preserving Parliament's independence. Citizens can observe the functioning of European institutions and their respect for democratic principles.
