The European Parliament has decided to lift the immunity of Polish MEP Mariusz Kamiński following a request from Polish authorities. This historic decision allows the continuation of criminal proceedings against him in Poland. The measure comes in the context of allegations that Kamiński violated a final court judgment prohibiting him from holding public office.
The procedure is based on Protocol No 7 on Privileges and Immunities of the EU, which states that Members of the European Parliament enjoy the same immunities on their national territory as members of their national parliament. The objective is to ensure balance between protecting parliamentary activity and the need for justice.
The decision was adopted in January 2025 and was immediately transmitted to Polish authorities. The immunity lifting procedure followed full consultations and the hearing of the MEP concerned. Control over implementation rests with Polish judicial authorities, in accordance with national legislation.
